Small Claims Court - Rules - Ex Parte Communications

No one shall directly or indirectly communicate with a Judge, Referee or Judicial Officer, the Judge's chamber personnel (including law clerks), the Clerk of Court, or the Clerk's Deputies and Assistants about any mater pending with the court except:

  1. In open court; or
  2. With the consent of all other parties or their counsel in such matters; or
  3. In the presence of all other parties or their counsel in such matters; or
  4. By means of motions, or other papers provided for or allowed by rule or law.

Nothing in this Rule shall prevent the Clerk of Court from entertaining questions or complaints.

The practice of writing a letter to a judge or judicial officer (even when the opposing party or their counsel receives copies of such letter) is expressly prohibited.
